These Terms of Service (“Terms”) together with our Privacy Policy (collectively, this “Agreement”) form a binding agreement between you (the “User”) and OneRoam Communications LLC (“OneRoam,” “we,” “us,” or “our”).
This Agreement governs your purchase and use of OneRoam’s eSIMs, data plans, and related Services available through our website or mobile application.
By purchasing, activating, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and the OneRoam Privacy Policy.
If you do not agree with any part of these Terms, you must not purchase, activate, or use the Services.
1. Definitions
In these Terms, the following definitions apply:
- “Account” means the User’s registered profile created on the Website or mobile application to purchase, manage, or activate Services, and through which OneRoam may communicate service-related information.
- “Device” refers to the User’s mobile device which must be eSIM-compatible and network-unlocked, and therefore capable of installing and using an eSIM profile.
- “Data Plan” refers to a prepaid allotment of mobile data purchased through OneRoam for use in accessing mobile internet services.
- “eSIM” means a digital SIM profile that enables a Device to connect to a mobile network without requiring a physical SIM card.
- “OneRoam” refers to OneRoam Communications LLC, together with its affiliates, successors, and assigns, but only to the extent such affiliates perform the Services or other obligations under this Agreement, which provides the digital eSIMs, Data Plans, and related Services described in this Agreement.
- “Services” means the digital eSIMs, prepaid Data Plans, and associated digital communications tools, applications, or customer support functions made available by OneRoam.
- “Third-Party Carriers” means mobile network operators, roaming partners, or other connectivity providers (including any affiliates of OneRoam acting in such capacity) whose networks are used to provide the Services.
- “User” or “you” refers to an individual consumer who purchases, activates or uses the Services for personal, non-commercial purposes.
- “Website” means the OneRoam website located at www.oneroam.com, including any subdomains or mobile-optimized versions through which the Services are accessed.
2. Changes to Terms.
OneRoam reserves the right to update or modify these Terms at any time by posting the revised version on the Website. Continued use of the Services after any such changes constitutes your acceptance of the updated Terms.
3. Eligibility
- 3.1 You must be at least 18 years of age, or the legal age of majority in your country of residence, whichever is greater, to purchase or use the Services.
- 3.2 The Services are solely for personal, non-commercial use. You may not resell, transfer, or otherwise distribute any Data Plan, eSIM, or related Service to any third party without the prior written consent of OneRoam.
- 3.3 By using the Services, you represent and warrant that you have the legal capacity and authority to enter into this Agreement and to comply with its terms.
4. Device Compatibility and Requirements
- 4.1 You are solely responsible for ensuing that your Device is both eSIM-compatible and network-unlocked before purchasing or installing a OneRoam eSIM.
- 4.2 OneRoam does not guarantee that the Services will function on all Devices or with all operating systems. Device models, firmware versions, or carrier restrictions may affect functionality.
- 4.3 OneRoam shall not be liable for any inability to access or use the Services resulting from Device incompatibility, configuration issues, operating-system updates, or other technical conditions outside its reasonable control.
- 4.4 Refunds will not be issued for failures arising from an incompatible or locked Device.
5. Service Description and Availability
- 5.1 About the Service. OneRoam provides digital, prepaid eSIM profiles that enable Users to access mobile data services in supported countries and regions through participating Third-Party Carriers.
- 5.2 Network Coverage and Performance. Network coverage and speed may vary depending on your location, local infrastructure, and the policies or operations of the applicable Third-Party Carrier. Service availability also depends on external factors such as signal strength, device settings, and network congestion. For eSIM services used at sea, maritime coverage is limited and may vary. Coverage is generally available only in international waters, may not be continuous, and may not be accessible throughout the vessel. Actual availability depends on the ship’s equipment, location, weather conditions, and the applicable Third-Party Carrier.
- 5.3 Service Availability. The Services are provided on an “as is” and “as available” basis. OneRoam does not warrant uninterrupted access, continuous coverage, or any minimum data speeds.
- 5.4 High-Usage and Fair-Use Policy. To maintain network quality and equitable access for all users, OneRoam may apply a high-usage or fair-use policy to certain Data Plans, including plans advertised as “unlimited”:
- Throttling Threshold: If your data usage exceeds the threshold specified in your plan (or, for “unlimited” plans, a threshold reasonably associated with fair use), data speeds may be reduced for the remainder of the plan’s validity period. Use of hotspot/tethering, if enabled on your device or plan, may be subject to throttling as necessary to maintain reasonable usage limits.
- Throttling Impact: Throttled data speeds are typically sufficient for light activities such as browsing, email, and messaging but may impair higher-bandwidth activities such as video streaming, gaming, or large file transfers.
- Unlimited Plan Fair Use: For plans advertised as “unlimited,” OneRoam reserves the right to apply reasonable usage limits to prevent misuse or degradation of network performance, and data speeds may be throttled once usage exceeds the applicable high-usage threshold for that plan.
- No Extra Charges: Throttling under this policy does not incur additional fees.
- Examples of Excessive Use: Examples of excessive or abnormal use that may trigger high-usage or fair-use controls include unusually high or sustained data consumption, automated or non-personal traffic, or usage patterns inconsistent with typical individual mobile use. These examples are illustrative only and do not limit OneRoam’s ability to manage network performance as needed
- 5.5 Third-Party Networks. OneRoam relies on Third-Party Carriers and their respective mobile networks to deliver connectivity. Because OneRoam does not control those networks, it is not responsible for outages, throttling, or performance issues caused by them. Accordingly, OneRoam expressly disclaims all liability for any loss, damage, delay or disruption arising from any act, omission, or failure (including interruptions or outages) of any Third-Party Carrier’s network, infrastructure, or service interconnections. This includes, without limitation, dropped connections, coverage gaps, data throttling, or reduced data speeds due to network congestion, outages or prioritization policies.
- 5.6 External Factors. Users acknowledge and agree that mobile connectivity, including international roaming, eSIM activation, and data performance may be affected by variables beyond OneRoam’s control, such as such as regulatory restrictions, local carrier settings, or device-specific limitations.
6. Purchase, Delivery, and Activation
- 6.1 Purchases. All purchases of Data Plans must be completed through OneRoam’s official Website or mobile application. All plans are prepaid and non-renewing, unless otherwise stated at the time of purchase.
- 6.2 Delivery of eSIM. Upon successful payment, the eSIM profile will be delivered digitally to the User through one or more of the following methods:
- a QR code sent via email or displayed in the User’s Account;
- a secure installation link; or
- direct in-app download within the OneRoam mobile application.
- 6.3 Activation. You are responsible for activating your eSIM within the validity period specified in your plan order confirmation. Failure to activate the eSIM within that period may result in expiration and permanent loss of the Data Plan. No refunds or credits will be provided for unactivated or expired eSIMs.
- 6.4 Verification. OneRoam reserves the right to verify and authenticate any purchase, payment, or user identity prior to eSIM delivery or activation to prevent unauthorized use or fraud.
- 6.5 Technical Support. Basic instructions for eSIM installation and activation are provided on the Website and/or in the order confirmation. Users are responsible for following these instructions and ensuring Device compatibility as described in Section 4.
7. Account Information and Registration
- 7.1 Account Creation. To purchase or manage certain Services, you may need to create a OneRoam Account using a valid email address and other required details. You agree to provide accurate, current, and complete information during registration and to keep your Account details updated.
- 7.2 Account Security. You are responsible for maintaining the confidentiality of your Account credentials, including your password, and for all activities conducted under your Account. If you suspect unauthorized access, you must notify OneRoam immediately at support@oneroam.com
- 7.3 Account Use. Accounts are for individual use only and may not be shared, transferred, or used to manage multiple users or devices unless expressly permitted by OneRoam.
- 7.4 Account Suspension. OneRoam reserves the right to suspend or terminate your Account if false information is provided, if the Account is misused, or if necessary to protect the integrity or security of the Services.
8. Duration and Expiry
- 8.1 Service Term. Your Service begins upon activation or first use of the eSIM, whichever occurs earlier, and will automatically terminate when:
- Your Data Plan allowance is fully consumed, or
- The validity period stated for your plan (e.g., 7 days, 30 days) has expired, whichever comes first. Validity periods run continuously and cannot be paused or extended once activated.
- 8.2 Post-Expiry Status. After expiry or full consumption of the Data Plan, the eSIM profile will remain installed on your Device but will no longer provide connectivity. You may delete the expired eSIM profile at your discretion.
9. Payment Terms
- 9.1 Payment Due. All fees for the Services are due in full and in advance at the time of purchase. OneRoam accepts major credit and debit cards, digital wallets, and other payment methods displayed at checkout. Payments are processed through secure third-party payment gateways. Any per-day or informational pricing displayed on the Website or in marketing materials is provided for convenience only. The final total price shown at checkout constitutes the binding price for your purchase.
- 9.2 Taxes and Currency. Unless otherwise stated at checkout, prices are inclusive of applicable taxes and fees. Transactions are processed in the currency displayed at purchase; if your payment method operates in another currency, your financial institution may apply conversion rates and fees beyond OneRoam’s control.
- 9.3 Stored Payment Information. You may choose to store payment credentials within your Account for future purchases. You may delete this information at any time via your Account settings. OneRoam does not store full card data directly and relies on tokenized processing through certified payment providers.
- 9.4 Non-Payment. If a payment is declined or reversed, OneRoam may suspend or cancel the corresponding order or Service without notice.
- 9.5 Promotional Codes. OneRoam may offer promotional codes or discounts from time to time. Such promotions are subject to the eligibility criteria, limitations, and terms communicated at the time the promotion is issued. OneRoam may modify or discontinue any promotional code at its discretion.
10. Refund Policy
- 10.1 Eligibility. Refund requests may be considered at OneRoam’s discretion only if:
- The eSIM has not been activated, and
- The refund is requested within 30 days of the original purchase date.
- 10.2 Exclusions. Refunds will not be issued for:
- Data that has already been used or partially consumed;
- User error during eSIM installation or activation;
- Device incompatibility, except where OneRoam has expressly misrepresented compatibility;
- Network disruptions, limited coverage, or performance issues attributable to Third-Party Carriers or other factors outside OneRoam’s control; or
- Accounts that have been suspended or terminated due to policy violations.
- 10.3 Processing. Approved refunds will be credited to the original payment method within 10 to 30 business days, depending on the payment processor and financial institution.
11. User Responsibilities and Acceptable Use
- 11.1 Compliance. You agree to use the Services only in accordance with this Agreement, applicable local laws and regulations, and OneRoam’s published policies and usage guidelines.
- 11.2 Prohibited Uses. You must not use the Services in any manner that is unlawful, abusive, or inconsistent with their intended personal-use purpose. Without limitation, the following activities are expressly prohibited:
- Using the Services for commercial, enterprise, or resale purposes, or otherwise reselling, transferring, copying, distributing, or sharing the Services with third parties, including cloning or duplicating an eSIM, or sharing a Data Plan or eSIM across devices, or using more than one instance of a Data Plan on a single device;
- Engaging in or facilitating fraudulent, unlawful, deceptive, or harmful activities, including any attempt to gain unauthorized access to systems, networks, or data;
- Impersonating another person or entity, concealing your identity, or misrepresenting your affiliation to gain unauthorized access or otherwise misuse the Services;
- Installing or using an eSIM on a non-compatible, rooted, jailbroken, or carrier-locked Device;
- Acting in any manner that impairs or disrupts the operation, performance, security, or functionality of the Services or the underlying networks relied upon by OneRoam or its Third-Party Carriers;
- Engaging in excessive or abnormal usage that violates OneRoam’s or any Third-Party Carrier’s fair-use policies or degrades network quality for other users.
- 11.3 Suspension or Termination. OneRoam reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate your access to the Services if any misuse, violation of this Agreement, or suspicious activity is detected. No refund or credit will be provided in such cases.
12. Regulatory Compliance
- 12.1 Telecommunications Regulation. You acknowledge that the provision and use of telecommunications and data-connectivity services are subject to various laws, regulations, and governmental requirements in the jurisdictions where the Services are offered. Such regulatory frameworks may evolve over time and could affect the availability, functionality, or terms of the Services.
- 12.2 Compliance-Driven Modifications. In order to comply with current or future regulatory, legal, or operational obligations, OneRoam may modify, suspend, or discontinue any portion of the Services, or amend this Agreement, at any time. Notice of material changes will be provided by posting an updated version of this Agreement on the OneRoam Website and/or in the mobile application.
- 12.3 Continued Use as Acceptance. Your continued use of the Services following the posting of such updates will constitute your acceptance of the revised terms and acknowledgment of any regulatory changes that necessitated them.
13. Intellectual Property.
- 13.1 Ownership of OneRoam Materials. All content, technology, software, trademarks, logos, and other materials forming part of or displayed through the Services or the Website (collectively, the “OneRoam Materials”) are the exclusive property of OneRoam Communications LLC or its licensors and are protected by applicable intellectual-property and unfair-competition laws worldwide. Subject to your continued compliance with this Agreement, OneRoam grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and the OneRoam Materials solely for your personal, non-commercial use. No rights are granted or implied beyond this limited license. If you submit comments, suggestions, or ideas regarding the Services (“Feedback”), you agree that OneRoam may use such Feedback freely and without restriction for any purpose, without any obligation to compensate or credit you.
- 13.2 Restrictions. You must not, and must not permit any third party to:
- copy, reproduce, modify, adapt, translate, or create derivative works of the OneRoam Materials;
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in connection with the Services;
- remove, obscure, or alter any copyright, trademark, or proprietary-rights notice appearing in or on the OneRoam Materials; or
- use any trademark, logo, or brand element of OneRoam without prior written authorization.
14. Disclaimers and Limitation of Liability
- 14.1 Service Disclaimer. To the maximum extent permitted by law, OneRoam disclaims all representations, warranties, and conditions, whether statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Where the Services rely on third-party networks, applications, or payment processors, OneRoam is not responsible for their acts, omissions, availability, or performance. Your interactions with such third parties are governed by their respective terms and policies.
- 14.2 Limitation of Liability. To the maximum extent permitted by law, OneRoam shall not be liable for service interruptions, delays, or network failures; indirect, incidental, special, or consequential damages, including loss of data, profits, revenue, or goodwill; or device malfunction, incompatibility, or configuration issues. In no event shall OneRoam’s total aggregate liability to you for all claims arising out of or relating to this Agreement or the Services exceed the total amount paid by you to OneRoam for the Data Plan that gave rise to the claim.
- 14.3 Force Majeure. OneRoam shall not be liable for any delay, failure, or interruption in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, regulatory changes, strikes, labor disputes, power failures, cyberattacks, or network outages.
15. Indemnification.
You agree to indemnify, defend, and hold harmless OneRoam Communications LLC, its affiliates, officers, employees, agents, partners, and licensors (collectively, the “OneRoam Parties”) from and against any and all claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use or misuse of the Services; (ii) your violation of this Agreement or of any applicable law or regulation; (iii) your infringement or misappropriation of any third party’s rights; or (iv) any fraudulent, negligent, or unlawful act or omission by you or anyone using your Account or Device. OneRoam reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with such defense.
16. Privacy and Data Processing
- 16.1 Consent and Privacy Policy. By using the Services, you consent to OneRoam collecting, using, and processing your personal data in accordance with its Privacy Policy, which is incorporated into this Agreement and available on the OneRoam Website.
- 16.2 Purpose of Processing. OneRoam uses personal data solely to deliver, operate, and support the Services. We do not sell or rent personal data to third parties.
- 16.3 Data Handling and Third-Party Processing. To provide the Services, OneRoam may process information such as Device identifiers, activation data, and usage metrics. Certain functions (for example, payment processing or customer support) may be handled by trusted third-party providers acting on OneRoam’s behalf, each bound by contractual confidentiality and data-protection obligations.
17. Messaging Program (SMS / WhatsApp)
- 17.1 Opt-In Consent. By providing your mobile number and choosing to receive messages, you consent to receive automated and non-automated text messages from OneRoam, which may include service notifications, verification codes, activation instructions, and promotional or marketing content. Message frequency may vary.
- 17.2 Opt-Out. You may opt out of marketing messages at any time by replying “STOP” or following the opt-out instructions included in each message. Even if you opt out of marketing messages, OneRoam may still send you transactional or service-related messages (for example, to confirm your purchase or assist with activation).
- 17.3 Message & Data Rates. Standard message and data rates may apply depending on your carrier plan. OneRoam is not responsible for any charges imposed by your mobile carrier.
- 17.4 Supported Platforms. Messages may be sent via SMS, WhatsApp, or other supported messaging platforms. For WhatsApp users, communications are also subject to WhatsApp’s Terms of Service and privacy policies.
18. Governing Law.
This Agreement and any dispute or claim arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles.
19. Arbitration
- 19.1 Agreement to Arbitration. At OneRoam’s election, and to the fullest extent permitted by law, any dispute, controversy, or claim arising out of or relating to this Agreement or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in English and shall take place in Alpharetta, Georgia, or in another location mutually agreed by the parties, or by videoconference if permitted by the arbitrator. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement. The arbitrator shall have the exclusive authority to resolve all issues relating to the interpretation, applicability, or enforceability of this arbitration provision. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party shall bear its own attorneys’ fees and costs, except as may be awarded under the AAA rules or applicable law. Nothing in this clause prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights, confidential information, or to prevent unauthorized access to or use of the Services.
- 19.2 Class Action Waiver. To the fullest extent permitted by law, you and OneRoam agree that any arbitration or court proceeding will be conducted solely on an individual basis and not as a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of representative or class proceeding. If this waiver of class or representative actions is found unenforceable, the entire arbitration agreement shall be null and void.
- 19.3 Exceptions and Right to Opt Out. Either party may bring an individual action in small claims court if the claim qualifies. You may also opt out of arbitration within thirty (30) days of first accepting these Terms by emailing support@oneroam.com with your name, address, and a clear statement that you do not wish to resolve disputes through arbitration. We will confirm receipt of your opt-out request. Any request received after the 30-day period will be invalid.
- 19.4 Pre-Arbitration Process. Before starting arbitration or court proceedings, you must first email us at support@oneroam.com and provide:
- Your name and address;
- A brief description of your claim; and
- The specific relief sought.
We will acknowledge receipt and attempt to resolve the matter informally. If the dispute is not resolved within thirty (30) days after we confirm receipt, either party may commence arbitration (or small-claims litigation, if applicable).
20. Termination
- 20.1 By User. You may discontinue use of the Services at any time by deleting your Account or uninstalling the OneRoam eSIM from your Device. Prepaid fees are non-refundable except as provided under Section 10 (Refund Policy).
- 20.2 By OneRoam. OneRoam may suspend or terminate your access to the Services, with or without notice, if:
- you breach any term of this Agreement;
- required by law, regulation, or governmental order; or
- continued operation of the Services becomes commercially or technically impracticable.
- 20.3 Effect of Termination. Upon termination, all rights granted to you under this Agreement shall immediately cease. Sections intended to survive termination shall remain in effect.
21. Confidentiality.
For purposes of this Agreement, “Confidential Information” means any non-public, proprietary, or technical information disclosed by OneRoam to the User (whether in written, electronic, or oral form) in connection with the Services, including but not limited to network configurations, pricing structures, activation methods, system interfaces, and business processes. You agree to: (i) keep all Confidential Information strictly confidential; (ii) use such information solely for the purpose of accessing and using the Services; and (iii) not disclose, reproduce, or distribute any Confidential Information to third parties without OneRoam’s prior written consent. The obligations above do not apply to information that: (a) was publicly available at the time of disclosure or becomes public through no fault of the recipient; (b) was lawfully obtained from a third party without breach of any confidentiality duty; or (c) is required to be disclosed under applicable law or regulation, provided that reasonable prior notice is given to OneRoam (to the extent legally permitted). Upon termination of the Services or upon OneRoam’s request, you must promptly delete or return any Confidential Information in your possession, except where retention is required by law. You acknowledge that unauthorized disclosure or misuse of Confidential Information may cause irreparable harm to OneRoam, for which monetary damages may be inadequate. Accordingly, OneRoam shall be entitled to seek injunctive or equitable relief in addition to any other remedies available under law.
22. General Provisions
- 22.1 Entire Agreement. This Agreement, together with the Privacy Policy and any plan-specific terms presented at purchase, constitutes the entire agreement between you and OneRoam with respect to the Services and supersedes all prior or contemporaneous communications or understandings.
- 22.2 Severability. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid term shall be replaced by a valid provision that most closely reflects the original intent.
- 22.3 No Waiver. Failure or delay by OneRoam to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
- 22.4 Assignment. You may not assign or transfer this Agreement or any rights hereunder without OneRoam’s prior written consent. OneRoam may assign this Agreement freely to any affiliate or successor in connection with a merger, acquisition, or sale of assets.
- 22.5 Notices. All notices required under this Agreement may be provided electronically via email or through postings on the Website or mobile application. You agree to receive communications electronically, such as through email or postings on the Website, and acknowledge that such communications satisfy any legal requirement that such communications be in writing.
